1. These general terms and conditions apply to the sale of goods via our online shop. LOGOKRUG, LOGOTELLER and further categories still to come are products of Metma.

2. These general terms and conditions apply only to adult consumers who have their place of residence in the EU and wish delivery of the products to a postal address in the Federal Republic of Germany; we also sell the advertised products to businesses with registered offices in the EU wishing delivery to a postal address in Germany, as well as to legal entities with registered offices in the EU wishing delivery to a postal address in Germany. Self-collection is not possible.

1. All prices include the statutory value added tax plus shipping costs.

2. The purchase price plus shipping costs must be paid before the goods are dispatched. Price reductions require separate agreement.

If the buyer is a business, merchant or legal entity, the following applies:

The customer’s claims for defects become time-barred after 12 months. This does not apply

• – if we fraudulently conceal the defect;
• – if we have assumed a guarantee for the quality of the item / our service or a durability guarantee and the defect falls under this guarantee;
• – to any customer claims for damages aimed at compensation for bodily or health injury. We are liable to the statutory extent for every culpable violation of life, body or health.
• – to any customer claims for damages based on a grossly negligent breach of duty on our part or on an intentional or grossly negligent breach of duty by our legal representative or vicarious agent;
• – to claims based on a culpable breach of our duty to deliver the purchase item free from material and legal defects and our duty to transfer ownership thereof;

1. If the customer is a merchant, business or legal entity, the law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, even if the customer is based abroad.

2. If the customer is a merchant, our registered office is the place of jurisdiction for all disputes arising from or in connection with the concluded contract.

3. Should a provision be or become invalid, the validity of the other provisions shall remain unaffected.

Since 2016, the EU Commission has provided a platform for out-of-court dispute resolution. This platform is intended to enable out-of-court online settlement of disputes concerning contractual obligations from online purchase contracts or online service contracts between consumers resident in the EU and a business established in the EU.
